Do I still retain my previous I140 in case of approval or denial of the I140 my current employer if filing and can I use it for h1 extension. Would appreciate your reply. thanks Quote Link to comment
care_candidate Posted June 20, 2019 Report Share Posted June 20, 2019 No. In new application, you can request to retain PD based on older employer application; that way you don't lose lot of time. In addition, you can use older I-140 approval to extend H1b of your current employer. Once you get I-140 approved from new employer, you use that for further extension. However, it can go as much as that far only. It's like jumping from one rock to other. Once you are firm one second one, you don't get to go back. Quote Link to comment

The previously approved I-140 stands approved unless revoked by the employer and in any case, if it has been more than 6 months, you are entitled to H1 extensions till PD is current and with any H1 employer.
