Avish755
Hi, I have an Approved I140. Currently I am outside USA working for the same employer who filed my I140. Recently my H1B petition(CAP exempt due to approved I140) was approved but for only 90 days. Looking at the waiting time for VISA stamping & admin processing by the time my VISA is stamped it will be expired. So need your help on below: 1. What are my options if i want to continue with same employer. 2. Can i transfer my Approved I140 to new employer by staying outside USA and new employer can apply fresh H1B petition? pontevecchio
1. Another H1 extension for a longer time project. 2. Based on an approved I-140 with any employer, you can get H1 extensions with any suitable H1 sponsor till the PD is current. The I-140 belongs to that employer though you can retain the PD for another GC filing. Edited June 18, 2019 by pontevecchio Quote Link to comment
