zanki Posted March 28, 2019 Report Posted March 28, 2019 Hello, My employer filed my H-1B petition in the CAP Quota of FY19 and we received an RFE on Jan 25, 2019. My Attorney will respond to the RFE after Apr 6, 19 since they are busy with the cap cases for this year. Can my Attorney file a petition in CAP Quota of FY20. My Attorney says there will be a negative impact, but I am concerned that if my RFE gets denied, I may lose my chance of filing this year. Current Visa - F-1 OPT STEM Masters CAP Thank you so much!
