Ish_kk2019 Posted March 11, 2019 Report Share Posted March 11, 2019 I have got my H1B picked from 2014 April lottery and I came to US in Oct-2014 on my H1B visa and In 2016, I got married and my husband is working in a different employer "A" in H1B and his I-140 approved. Hence in June-2016 I changed my status from H1B to H4 EAD and working for the same employer "A" since then. Now due to the recent H4 EAD revoke process (not official yet, DHS submitted the H4 EAD revoke rules to OMB, still waiting) I am working on changing my status back to H1B. Since I have already got my H1B picked in 2014 lottery cap, my employer "A" agreed to change it using H1 Cap exempt. Now my questions are 1. "After changing my status from H4 EAD to H1B using Cap exempt process, Will I be able to change my company? Is there any limitation in changing company?" 2. "whether entire H1B and H4 EAD period will be considered for 6 years or only H1B period will be counted towards total work period?" Link to comment
