Sunilsps82 Posted March 8, 2019 Report Posted March 8, 2019 Hi, we recently applied for H1 extension in premium processing as our expiry date is coming close (June) and uscis response reflected indent to deny application mentioning that applicant was not present in US at the time of filing the case. The fact of matter is that I never left country in last three year. Has anyone faced this kind of situation ? Any suggestion around how to respond in this situation?
Provence Posted March 8, 2019 Report Posted March 8, 2019 This needs to be directed to your employer's Attorney who submitted the Extension documentation. Attorney would respond to the NOIR with your travel evidence, or lack thereof.
xTDx Posted March 8, 2019 Report Posted March 8, 2019 Please work with your attorneys to respond to USCIS. They should soon receive an official communications from USCIS and the last date to reply with evidence. Seems like a clerical error.
