H4 while H1B extension is pending

Hi,

My H1b is applied in Jul 2018 and I got RFE in Feb 2019. due to some delay, my employer has not yet updated the RFE status and am still not aware the reason for RFE. My 240 days is getting completed on Apr 3rd 2019 and am not sure if my employer will file it and get an update before Apr 3rd.

My husband is on valid H1b visa. so, can I go back to India and get H4 stamping and travel to US on H4 while my H1b processing is still in pending?

Personal advice possible change employer and apply H1B. What kind of employer doesnot take RFE of an employee seriously and try to solve it. Shady employer does it.
