Sri230582
HelloI have my I140 approved in the month of Jan, do I need to stay with current employer for 180 days before I switch jobs. If I change before 180 days does my current i140 remains valid and I can get H4 Ead extension based on this i140.Or I can change my job and request my current employer not to revoke i140. Or is mandatory for my current employer to revoke my i140 as it may have some consequences. Please help. Link to comment
pontevecchio
As long as the I-140 is pending more than 6 months, you are covered. I would point you in the direction of the Murthy website which has a lot of relevant Information. It is not mandatory to revoke the I-140 of an employee who leaves. Link to comment
Sri230582
Thanks for the reply. But if I transfer H1b, my employer needs to revoke my H1B since its mandate from USCIS. So if my H1B is revoked doesnt it automatically revoked my i140 as well? since H1B was base for i140 application. What is that I can do to ask my employer not to revoke my I140. Id he doesnt revoked will there be any legal complication again my employer. Appreciate your help Link to comment
