Meena Sharma
My Current I-140 is approved 2 years back and MaxOut period is over . I got offer from new company. 1. As stated in email by my current employer, that they will revoke I 140 if i leave organization . Is it possible for them to revoke I-140 if I have completed 2 years after receiving i140 2. If I switch and my new employer does not file my GC. Is it possible to get further extension using my old I 140. 3. My current GC is filed in EB2 and my new employer will file GC in EB3 . Will that be an issue. Link to comment
pontevecchio
1. Yes. But you retain the Priority date and are eligible for H1 extensions till that PD is current even if the employer revokes the I-140 as per the new rules. 2. see 1. 3. NO Link to comment
