h1f1h4h1 Posted July 28, 2011 Report Share Posted July 28, 2011 Hi, I have the following case. ----------------------------------- H1B: Mar 2006 to Mar 2008 H1B extension was filed before Mar 2008. The case went in RFE status and additional documents were sent. I worked on H1B till Jun 2008 and then resigned to go back to school. I do not know what happened with the approval. F1: Aug 2008 to June 2010 F1-OPT: June 2010 to Oct 2010 Current: H4: Dec 2011 - to date ----------------------------------- I am currently looking for a job and need an H1B. As far as I know, I won't fall under quota because I had an earlier H1B and also have Masters degree. My question is: Am I eligible for an H1B transfer? I know that H1B transfer works on H4 but I am not certain if my H1B was successfully extended (and is tranferable). What would be the correct process for me to get an H1B now? Link to comment
pontevecchio Posted July 28, 2011 Report Share Posted July 28, 2011 H1 transfer is a misnomer. It merely means a person in H1 status is changing H1 sponsors and jobs while in H1 status in the USA. You are entitled to 6 years minus 27 months in H1 status. Every change of H1 Employer mandates a new H1 petition filing. You will have to show that your spouse is in valid H1 status. Link to comment
