Do you just file paperwork for the brother or do we also need to file paperwork for his wife? Do we just file I-130 for the brother along with I-485 or just I-130 first? pontevecchio Posted April 29, 2018 Report Share Posted April 29, 2018 Look at the actual I-130 and spouse details etc. have to be filled up. You will file I-130 for your brother. AOS is applicable only when the PD is current in about 14 years and they are in status in this country. Otherwise consular processing is involved. Link to comment
