Given the recent news on this, I would like to move to H-1B status through a new employer (employer Y) using a non-cap exempt petition (i.e., new H-1B filing). My questions are as follows - 1.) If my H-1B gets approved what would happen to my H4-EAD? What will be the effective date for this, 01 October 2018? 2.) Do I need to stop working for employer X if my H-1B gets approved? Regards 1) When your H1B is approved, yourH4-EAD is gone. You will be on H1 status from Oct 1st. 2) Yes, you cannot work for Emp X if your H1B is for Emp Y. If your empX files your H1B, then you can continue working for Emp X from Oct 1st. Quote Link to comment
