anusha23 Posted September 15, 2017 Report Posted September 15, 2017 Hi, My H1b is under processing after replying to the RFE on Aug 28, 2017. In the mean while, I've received a full time offer. I've been stuck in a pretty stagnant job with not a lot of work for the past two years. I'm interested in this full time position in more than many ways in terms of future opportunities, location and personal growth. Now that I've described how much this job means to me - I made a blunder during the HR interview, I told them that I am on H1b expecting the interview process to take a while and I hoped that my application would be approved by then. Is there anyway I can prove my immigration status to this new firm without conveying that my first H1b is under processing. I thank y'all in advance.
pontevecchio Posted September 15, 2017 Report Posted September 15, 2017 Are you saying this is your first H1 and you are in F1 status now?
anusha23 Posted September 16, 2017 Author Report Posted September 16, 2017 Yes, I am on my F1(been for the past 7 years).
JoeF Posted September 17, 2017 Report Posted September 17, 2017 If your H1 is not approved, a transfer isn't possible. There is nothing to transfer because there is no H1 to begin with. Also, once approved, you have to start working for the original employer before a transfer can be filed.
