H1 B trasfer from India to US-No Stamping

Hi Everyone,

Here is my situation. I am working in USA on H1 B. My wife is in india working for company A where she has a H1 and there was never a stamping done. Her H1 is going to get expired in Dec 2017 and the company has no projects to send her here.

Here are my questions:

1. If she travel to USA on H4 will she be able to transfer her H1 later and work ?

2. If yes, then what are the documents that are needed for H1 B transfer from India Company A?

3.Need inputs for better ways to handle my case

Since presumably significant earnings are at stake and in view of the new changes , you should have her discuss specifics with a lawyer, maybe the firm of Murthy instead of casually tossing it in to the ring as it were.
