avicoolstar Posted July 17, 2017 Report Posted July 17, 2017 While my I140 is just submitted , my L1B is maxing out within a month. H1B , L1A conversion not possible due to eligibility. If I travel back to India and my I140 gets approval , how long I have to wait for filing H1B? Can my employer file H1B in 2018 CAP? I am assuming 2018 H1B CAP approval will only extend Max out by 1 year but can continue extending it using approved i140. Appreciate your response.
pontevecchio Posted July 17, 2017 Report Posted July 17, 2017 You mean the 2019 cap with application of a cap subject H1 one year after you have left the country. So realistically the H1 application could be made in April, 2019. It would be easier for you to work for one year and return in L1 status if possible.
