His employer filed for our GC by concurrently filing I-140 and I-485 applications in April 2017 under EB1C category. My current EAD (based on my L2 status) expires on 8/31/2017. Can I file for an EAD/AP before his I140 is approved? Thank you for your views and opinions in advance.

JoeF Posted July 12, 2017 Report Posted July 12, 2017 If the PD is current, both your husband and you can file I-485s, even if the I-140 is not yet approved.
shandan Posted July 13, 2017 Report Posted July 13, 2017 What @JoeF was trying to say is, if you have a pending I-485 application, you can file for an EAD based on that (your own pending I-485 application) and do not need to worry about your husbands I-140 approval. Hope this helps and clears your doubt.
