ramkc6 Posted July 6, 2017 Report Posted July 6, 2017 Hello, My H1B (Visa Stamped in Passport) is expiring in last week of Sep 2017 with my current employer. I am planning to change jobs & get H1B extension done with new employer. The new employer will start my H1b extension in a week. Also I am planning to goto India for sister-in-law marriage in Aug 1st week and return by last week of Aug 2017 using my H1B receipt notice and valid visa stamp (till sep 2017 from my old employer). My question is when I return back what will be my new I-94 expiration date? Will it be given only valid till Sep 2017 or will they be giving more time for I-94 Expiration date as my H1B extension is still pending? Or even if they give I-94 Expiration till Sep 2017 can I still stay beyond that using 240-day rule as my H1b Extension is pending? what are my options to maintain legal status? Any help would be greatly appreciated. Thank You!
