My current H1 (after all recaptured time etc.,) is on the 6th year and is valid until July 2nd 2017. I am still with employer A and My labor PERM was filed by employer B(future employer) in Oct 2016, got approved as of Dec 16 2016. Please let me know my options as below as I'd like to move to employer B. 1. Can my new employer B transfer my H1 B based on the Labor PERM approved? Will i get an additional year? 2. Heard from few friends that my new employer B should have applied I140 and with that receipt he can apply for H1B transfer, Is this valid or true? 3. When checked with the new employer B he says that H1B transfer can be applied based on Labor PERM approval and parallely he will apply for I140? Can this possible. I know it's a lot of questions, but please let me know what you folks suggest as its very critical and urgent for me. Please help!! Thanks. Link to comment

pontevecchio Posted February 11, 2017 Report Share Posted February 11, 2017 1. PERM approved does not give any H1 extension beyond the initial 6 years. 2. Approved I-140 or one pending 365 days is needed for extensions. B could apply for the I-140 for you with PP. 3. I doubt it. Are you working for a DCC? Link to comment
