L1B to H1 B conversion while in USA and out of USA for >1.5 years impact on Max possible stay

Hi,

　

I had initially come to USA on L1-B in year 2011 and then my L1-B was converted to H1-B in 2013 while I was in USA and then I repatriated to India in Jan 2015 and I am now back to USA in Aug 2016

　

Before coming to USA I had to undergo the H1-B Cap exempt process

　

　

1) I want to know if total number of day I spent in USA while on L1B also is considered ?

　

2) I was outside USA between Jan 15 to Aug 16 so was wondering if my Max possible stay counter gets reset based on this ?

1) yes it will be counted.

2)no reset, as yours was H1b->L1b.

1) Your L1B days are also counted.

2) Counter is reset only if you stay out of country for 1 year and apply for H-1 in lottery.
