EB1 green card filing

Hi,

My husband is in L1 visa and his 7 year term will expire by April'2017. His company is in the process of filing his GC in EB1 category (Multinational managerial executive). What will happen if attorney files his EB1(I140/I485 concurrent filing) by March'2017 and if I140 is still not approved?

Question1: Do we have to be out of the country after expiry date? 

Question2: Can we come back to US once we get the combined EAD and AP?

Please help as we are also pushing attorney to file as soon as possible.
