TJKUMAR Posted December 5, 2016 Report Share Posted December 5, 2016 My H1B visa is valid till SEP-2017 (H1B stamp on old passport and I-797) but my I-94 is valid till Dec-2016,because my old passport was expiring in Dec-2016. I already renewed my passport so now my question is how to get new I-94 with new validity date? 1. Do I have to leave the country and re-enter again to get new I-94? 2. Can I contact the local CBP office and get the new I-94? 3. Apply for new H1B extension to get new I-94 (As immigration lawyer advised)? can I apply for H1B extension and get new I-94? # I heard that we cannot apply for H1B extension before 6 months of current H1B (I-797)expiry date. OR # we cannot apply for H-1B extension more than 6 months in advance of the expiration date of your I-94. In my case, Since my new I-94 is only valid until 12/26/2016 this now overrides or trumps my previous I-797 which was valid until 9/7/2017. SUMMARY: 1. I-94 validity: 12/26/2016 2. I-797 validity : 09/07/2017 3. H1B visa stamp on old passport validity: 09/07/2017 All advices and suggestions are welcomed. Link to comment
shekar11# Posted December 8, 2016 Report Share Posted December 8, 2016 You can just cross the border at Canada or Mexico and get your I-94 updated. That is the easy process. Or else go for an extension as your lawyer suggested. Link to comment
