chnrbk Posted December 4, 2016 Report Posted December 4, 2016 Dear Murthy forum friends, I think my following may be asked by some one but I could not find exact question in the forum. I have left only 1.2 months only left out of 6 year stay limit in USA (this is afterrecapturing the time and considering limit by taking start as date entered USA to till date) 1) Can I transfer (i.e extend) my current H1B(with employer A) to new employer(say B) with i140 approved as I have only 1 year left. my current I-94 expires 2 months. 2) can I use i140 from employer A to extend/transfer my h1b to employer B and further extensions beyond 6 years while with Employer B until B files my GC again. Please advise all consequences of this if any. FYI- let say i140 approved few ago only.
pontevecchio Posted December 6, 2016 Report Posted December 6, 2016 1. Yes 2. Yes, as long as the I-140 stays approved.
