Last year September my 140 (PD Feb-2014) approved with my employer in EB2 India category. But my employer is not wiling to share any documents related my GC. My husband didn't applied for GC yet. With the changing immigration rules and tough competition I want to be in safe zone. Here are some doubts I have1. We are planing to start GC processing for my husband. If he apply now can he retain my priority date. 2. Through FOIA I got all the GC related documents except approved 140 copy.(since its employer doc) I if change employer can I retain priority date. What are the chances I will not able to retain my priority date with new employer.
JoeF Posted October 25, 2016 Report Posted October 25, 2016 Your husband's GC process would be independent of yours. He can not reuse your PD. Only you can reuse your PD for a new application.
