Visitor Visa when Immigration Visa for Sibling pending

Hi,

 

Want to know if an immigration visa for a US Citizen's sibling and sibling's family (spouse and minor children) is pending, then is there any problem or issue with getting a visitor visa in India (B1 or B2) or for reapplying for a visitor visa for the sibling (and sibling's family) while the sibling category immigration visa is pending. Note that since there is a long time gap before the sibling immigration is approved, the sibling (and family) may need to apply for the US visitor visa again. Please clarify.

A visitor visa requires that the person has no immigration intent.

If an i-130 was filed, there is demonstrated immigration intent, though.

It is less probable and depending on the VO involved there may very well be a pragmatic view taken. Obviously they need to apply in order to find out.
