H4 Visa stamping without H1 visa stamped.

Hi All,

 

My H1 visa is going to expire on Mid Sep 2016 and so my employer applied for my h1 extension and I got my H1 extension approved.

 

I didn't include my wife's H4 for extension while applying for my H1 extension.

 

Now my wife has to go for India and since her visa is expiring on 17th Sep 2016, she will attend visa stamping before coming back, and I have couple of questions:

 

1) Does she need her H4 extended before going India and attend visa stamping, OR she can attend visa stamping with my H1 approval notice?

 

2) For H4 visa stamping, do I required to have my new extended H1 visa stamped on my passport or just my i797A is enough?

1. She ONLY needs your H1 approval.

 

2. You need to be in valid H1 status and do not NEED to have a visa stamp.

Please let us know soon if your spouse's H4 visa got approved without your H1 visa as I am in similar situation now.
