sahch
Hi - My 6 years of H1B will be expiring in Feb 2017. My company now agreed to file my Green card. How ever with only 6 months left, they would want to apply for H4 EAD first ( Spouse has approved I 140) and then apply for Green card since the labor process takes a long time and they are afraid that I will loose my status by then. Is it ok to first convert to H4 EAD and then apply for Labor? How does that work since my status then will be H4 and how can they apply for my labor based on H4 status? Thanks a lot for your time! pontevecchio
Yes. This is a good way to do it. PERM application is irrespective of status or even presence in the USA. Link to comment
