However, with my previous employer, I worked (one of the key member) on a proprietary product which the company went on to file a patent and got it approved. I would like to check, if there a possibility, I could convert to EB1 by proving the patent and other expertise. And, in total I have 10+ years of experience in my job. Worker11 Posted July 19, 2011 Report Share Posted July 19, 2011 If you mean EB1(a), then one patent is NOT enough for it. You need to meet at least three of ten criteria to be qualified to be considered as an alien with extraordinary ability. Link to comment

Joe.F Posted July 20, 2011 Report Share Posted July 20, 2011 Even if your name is on the patent (you don't say), it won''t help all that much. For an EB2-NIW, having your name on a patent may work, but probably not for EB1. You should discuss this with a good immigration lawyer. Link to comment
