gc2ctzn
I jot laid off mid March, right before the coronavirus situation became widespread. I am on green card since dec 2018. Couple questions ... Will filing for unemployment benefit - be considered public charge ? have a negative affect during the citizenship process when I become eligible (potentially in 2023)? newacct
No. 1. Unemployment benefits are not means-tested benefits and are not considered for public charge determination. https://www.uscis.gov/policy-manual/volume-8-part-g-chapter-10#S-B-1 Quote The following is a non-exhaustive list of public benefits that USCIS does not consider in the public charge inadmissibility determination as they are considered earned benefits: * Unemployment benefits; 2. Public charge is not relevant in the naturalization process anyway. https://www.uscis.gov/policy-manual/volume-12-part-d-chapter-2#S-A-1 Quote The public charge ground of inadmissibility does not apply in naturalization proceedings. waitgame27
Thanks for the post and answers provided. My question is similar to the original but instead of layoff, I want to take time off under CARES Act or FFCRA. Will using paid leave benefit to take care of child that pays 2/3 of salary (upto a limit) impact citizenship application while the spouse still works. Is there any household income limits? Both myself and spouse are on family based green card. Thanks and stay safe all! Quote Link to comment
