H1b visa stamping appointment update receipt num after extension

Recommended Posts

Hello,

My current I-797 application is valid till April 2020 and my employer said they will apply for H1B extension on Feb 2020. I have plans to visit India on March 2020 and return back by April 1st week. I am thinking to book visa stamping appointment (around 3rd week of March) based of my existing/valid I-797(till April 2020). As part of visa stamping I will give this petition/receipt number in DS 160 form but if my extension get approved in premium before appointment then would it be possible to update the DS 160 form with new approved petition number and attend the Visa interview or do i need to reschedule interview?

Other scenario:

In case, if my extension NOT get approved by the appointment time (could be March on 3rd week), is there any risk of denial of stamoing as I have my H1B petition(April 2020) valid just one more month.

Please help with the above two scenarios. Thanks

Do not submit DS 160 and wait till 2 days before your interview. If you already submitted create new one submit it and take both old and new DS 160 confirmation page to finger print and ask them to update.

At finger print you can ask them to update H1B recepit number  in your interview profile site also. I guess.

They may check whats with your extension status.

Better to talk to an attorney as you are traveling very close to the end date for stamping and also travel while your petition is being processed by USCIS which is not advised. There are other possibilities too other than that scenario you mentioned, so getting some legal advice is best.
