But, the brother doesn't want to settle here anymore, as being quite aged and other problems. Nevertheless, the brother's daughter wants to pursue higher studies here and wants to continue be on Green Card. Is there a possibility that the Child can study here on Green Card, and parents be in their country. They all can come initially to get the stamping done. Please clarify. thanks. newacct Posted November 26, 2019 Report Share Posted November 26, 2019 Yes, if your brother's daughter has not aged out, and still qualifies as his derivative beneficiary, she can immigrate to the US with him, and then he can surrender his green card after she enters (thus becoming a permanent resident), and it would not affect her permanent resident status.
