aranjan2
Hi, I was with employer A and joined another employer B with valid H1 stamping. But my H1B stamping expired on October 2018 and my H1B transfer with employer B was still in process. In Oct-2018, my petition for H1 transfer got denied from USCIS, however I had changed my employer and went to Company C before the denial. I got it approved before my first Visa was expired. While filling the application for Visa, I need to answer the question given below. Have you ever been refused a H-1B (temporary occupation, temporary worker or trainee) visa before?(Yes/No). So, for above question should I Answer Yes or No, my employer has asked me to put Yes there, is it right ? and is I am eligible for Drop Box ? Please advice ..! Link to comment
luck2u
Usually answer to that question would be "No" as it is about H-1B visa not the approval at USCIS. Please check with your employer/attorney again before you submit DS-160 and keep this thread update about their feedback so that it can be helpful for others even if I'm wrong. Link to comment
adshah84
Answer should be "No" as I797 is not a VISA Link to comment
gopalakrishnach
No.. your H1B petition is denied but not H1B visa. You did not attend H1B visa interview which resulted in denial... Link to comment
