DS-160 question (spouse I-140 approved)

Hi,

 

I am on H1B and planning to go for Visa stamping in India. As I was filling out the DS-160, the below quesitons came:

 

Has anyone ever filed an immigrant petition on your behalf --DS160?

 

My husband has I-140 approved through his employer and my details are mentioned in there. I wanted to confirm what will be my response to the above question.

Yes and mention his i-140 case number in your DS_160

In my case, I am on H1B with approved I140 and my wife is on H4.  I gave YES as answer and in Explain I gave.

My husband XXX ( h1B receipt number EAC-xx-xxx-xxxxx) has approved I140 ( I140 receipt number ) petitioned by ( petitioner details )

As per my knowledge answer should be "No". As your name is no where in I140 or any other filling regarding GC. 

You will come into the picture at the time of filling 485.
