Anyone in any status (doesn't matter H1b, H4, F1, B2, O1, L1, or whatever) with a timely-filed, non-frivolous Extension of Status or Change of Status application is able to stay in the US for as long as the application is pending, with no time limit. pontevecchio Posted November 6, 2018 Report Share Posted November 6, 2018 There is a 240 day rule by which a timely filed H1 or H4 extension lets you stay for 240 days or until approval whichever is less. Why not leave and return with a H4 visa? Link to comment

Why not leave and return with a H4 visa? No, anyone in any status can always stay until approval, even if it takes years. Someone on H1 can work during pending extension for 240 after I-94 expires.
