Geetikaa Posted August 2, 2018 Report Share Posted August 2, 2018 My I-40 is denied, and my present H1B is till 10' Dec 2018 , And I will complete 6 years in June 2019. So If I appeal for my I-140 denial and file the H1b extension? for how much time will I get extension..will it be 1 year or 2 years? Link to comment

pontevecchio Posted August 3, 2018 Report Share Posted August 3, 2018 An appeal by itself gives you no protection. You are legally allowed to stay till June, 2019 in H1 status for which your employer will have to file an extension from December to June. Link to comment
