Emergencry travel on Expired H1B butValid I-94 and i797A

Hello. My h1b visa is from my old employer and it expired 2 months ago. But my i797 from my new employer is valid for another 8 months (until 02/2017). 5 months ago we did a 10 day trip to Mexico and my I-94 got extended to match my i-797 (02/2017).

 

Now, I had to make an emergency trip (1 week long) as my dad was hospitalized. I am now unsure if I can re-enter on the expired visa, but valid i797A and i-94.

 

Any info here would be much appreciated.

You have to get a new H1 visa.
