venkat_h1bvisa Posted May 27, 2016 Report Share Posted May 27, 2016 I have approved I-140 with my current employer(A) and I've used my 6-year h1b term and nine years completed on H1b. I'm transferring my H1b to new employer (B) now using approved I-140 from employer A. New position with employer B is contract to hire position for end client C. After few months(max 6months) I'll be moving to employer/client C. My question is during this time, my current employer revoke/cancel I-140 then, Am I eligible to transfer my h1b with employer C in that case? Employer B is also required to start my PERM process OR is it optional? Link to comment
NP2020 Posted June 22, 2016 Report Share Posted June 22, 2016 You should get 3yr extension with employer C unless employer A revokes I140 due to fraud. Employer B does not need to file Perm if your intent is to join Emp C. Link to comment
