Urgent!! Pls Advice H1B multiple petition got picked in lottery

Hi Everyone,

 

Recently my friend has filed 2 H1B petitions from 2 different employers and both have been picked, he is in dilemma and concerned about the following:

 

1) Should he inform the employers that his petitions have been picked.

2)When should he inform the employers that both his petitions have been picked (i.e., before approval or after approval). He holds good rapport with both the employers.

3) What factors should he consider for withdrawing H1B from one of the employer.

What status is he in currently? Petition being picked does not entitle any valid status. They are just picked for processing and its not mandatory that they will be approved. As far as informing the employer, is he working with anyone of them currently? if not it is upto him to decide which employer to join (only after approval) 

 

It is not mandatory to inform the employer even after approval. But he can when he decides he is joining the other employer.

If he is outside the US, he is not in any status, by definition.

If he is in the US in H4 status, he can not work, not even for a company abroad.

 

Both employers likely will get RFEs, because USCIS suspects that at least one of the applications got paid for by the beneficiary, which is not allowed, or that at least one of the positions doesn't really exist.
