H1 Extension withdrawn, can I apply H4

I came to US on H4 with my husband. Then I found job and got my H1B. I started working.

 

My H1B was expired December 2015 and my employer filed for extension. Last week(May 25th) my project ended unexpectedly and my employer emailed me that its my last day and they will withdraw my extension application.

 

Now my H4 is also expired. My husband asked his company to file H4 for me and they ignored saying if my employer has notified for withdrawal, my H4 wont be approved and they suggested me to travel to india and get the stamping from there.

 

My kids have school until May 28th, if it safe to stay till that date or should I travel sooner?

 

Is there other options for me?

 

Am I out of status? 

 

Did anyone had similar situation? Please help?
