confused_hustler007 Posted April 24, 2016 Report Share Posted April 24, 2016 Folks- Couldnt find anything in regards to situation where i140 is approved and approved since 2014 (over 2 years now) PD being feb 2013.. My employer did not file i485 since date isint current. I have the approval notice(thanks to foia) - My employer wont share any details on date with me as he is trying to hold me by saying I will cancel your 140 once u leave etc.. My question: My i140 is approved since 2014 (over 2 years) - passing 180 days I485 is not filed. I am planning to make a transfer and go a big consulting firm (pwc) and hoping they can get 3 year extension.. When they start my GC process and everything is clear.. can we use old approval date here? Everywhere I am getting details like only if you have both i140 and i485 filed this is possible.. no where i saw that if you only have approved 140 you can do it! Any advice? Thanks for your time. I tried my best to find a case like me where i140 was approved but no i1485 filed and i140 approved from over 2+ years.. so what can be done under that case.. I could find anything.. pontevecchio Posted April 26, 2016 Report Share Posted April 26, 2016 PD retention has always been possible and recently there have been a few exceptions. I suggest scheduling an Interview with a Lawyer to ascertain your position vis a vis PD retention. Link to comment
