bahlalisha Posted April 18, 2016 Report Share Posted April 18, 2016 Hi, I have an approved valid H1B visa till September 2016. It was filed by my previous employer. As I left the firm it got revoked last year. I never got a chance to travel on this visa or get it stamped. Now if I want to travel to US on this visa, am I cap exempt ? I have seen case where USCIS has accepted such cases as cap exempt, but not sure. Appreciate your response. Thanks much !! Link to comment
JoeF Posted April 18, 2016 Report Share Posted April 18, 2016 You are cap-exempt. H1 revocation is completely irrelevant for you. It is an administrative thing that the employer is required to do when the person on H1 no longer works there. It has no effect on getting another H1 later. Link to comment
