GREEN CARD FILING STATUS AFTER 8 YEARS OF APPROVED LABOUR FROM INDIA

I got my I140 approved from my previous employer on July 24 2009.

 

My priority date was June 12 2008.

 

I came back to india in 2010 and working in India from then. My H1B expired on 2010 Nov.

 

 

I have below queries :

 

1. Is my priority date still valid and my GC status still active

2. If so can I still apply for my GC from India? How much does it cost. 

3. Should I need an employer or can I do it on my own.

4. Green card was filed on my name can I include my family members into the GC now

1) If employer has not revoked your I40, then yes

2) No

3) Its a employment based GC, you will need employer to process it. Infact you will need same employer.

4) Your employers lawyer can take care of it.
