PERM approved, need extension beyond six years

Hello,

 

My PERM got approved recently and my employer is scheduled to apply for i140 in premium processing in a day or two.Today being 4/6/3016 I have less than 3 weeks left.

 

My end date is apr 22 2016 (6yrs complete with adjustments)

 

My employer feels it could be late before they can apply for 3 year extension, hence asking me to leave the country.

I cannot leave the country as my baby has a serious medical condition.My spouse is on H4.

 

Please let me know the options , as I have only two weeks to decide.

 

1. Can we  apply for visitor visa and stay back ?

2. Or can my spouse alone apply for visitor visa , so that atleast she is with the baby?

 

any other options.

Hi Praveen,

 

Recently, I too applied for I-140 in premium, it is approved exactly in a week(applied March 3rd, got approved information on March 10th). So go for premium, I hope you can apply for extension immediately and continue to stay.
