Can H1 B extension be filled after PERM is filled.

Hi All,

 

My exiting H1-B visa expires in April 2016 and I have another 8 months remaining on my visa after April-16 to complete 6 years (6th year completes in Jan 2017). The PERM was filled in October 2015 and I do not expect approval to come before April, can an H1 extension be filled for remaining 8 months and is the 365 day cap for PERM consider before 1 year the visa expires or 1 year before the 6th year expiry date.
