salunkepratik Posted January 13, 2016 Report Share Posted January 13, 2016 Hi All, I was with company A and I got my I-140 approved with PD : 12/6/13. Now I changed my employer and now company B started my Green card process and seems will take 2 yrs to get to my I-140. My question is can I still apply for my wife's EAD based on my previous approved I-140?...since my current employer is different then the one which I had got my I-140 approved with. I got mixed answers and was hoping some of you might help me here. Appreciate all the help and input :) thanks, SP Link to comment

rohang Posted January 13, 2016 Report Share Posted January 13, 2016 EAD can only be applied if your I140 is still active. If your previous employer revoked your I140, then you cannot file for EAD. Link to comment

rohang Posted January 14, 2016 Report Share Posted January 14, 2016 fyi: I140 should not just be valid when you are applying for EAD, it has to be valid throughout. If previous employer revokes I140 (and that they can do without informing you), EAD becomes invalid immediately. Link to comment
