rittu_2015 Posted December 29, 2015 Report Share Posted December 29, 2015 Hi, I am in my 6th year of H1b which will be expiring in july 2016. My last year extension is still pending- filed may 2015. However my company did not include the time away from USA in the extension which is around 2.5 months. My PERM is in process and so I badly need the 2.5 months extension. I was planning to do Premium processing for the H1b extension. My question is while my H1b extension is pending can I file for the extra days outside of USA and do premium processing for both at the same time or I have to pay Premium processing separately for both the extensions? Also if I don't get my I140 before the H1b runs out will the application still be in process while I leave USA till it is approved? Are there any other options available? jairichi Posted December 30, 2015 Report Share Posted December 30, 2015 Yes, employer can do PP for recapturing days spent outside US as one single petition. Even if you exit US I-140 will still be processed. Link to comment
