Request for Urgent Help - PERM DENIED- same employer can file application again immediately ?

Hi,

 

My PERM application (EB2) is denied recently after Audit. My current employer is not going to contest the decision. 

 

Can my current employer start process of filing again in  EB2 immediately or there is any cooling off period?

When its already denied what's the use of filing another application for the same position?

What was the reason for the denial? If it was related to your employer, then change your employer before filing a new Perm.

Your employer can certainly file new PERM right away. Reason for denial is very important. Sometimes the attorney or employer provides insufficient/incorrect information which can be explained as human error. If there is willful misrepresentation  and fraud then you have no hopes of getting new PERM approved with the same employer.
