That means I have never traveled on this h1b to USA. The employer cancelled my h1b as I did not join them. Will I be cap exempt in future if I get a new employer who can file my h1b in future based on this petition? Can I be cap-exempt even though totally unused h1b was revoked? Please guide. JoeF Posted December 21, 2015 Report Share Posted December 21, 2015 You are not considered counted in the quota, since you didn't start working for the employer. A new employer would have to file an H1 in next year's quota. Link to comment
