chirus12 Posted April 20, 2011 Report Share Posted April 20, 2011 Hi, I moved to US with my husband on H4 visa.The company that I worked for in India is willing to initiate a L1 for me.Would you pls let me know the procedure for the conversion from H4 to L1. 1.Can I stay in US when my L1 is in process 2.Should I go back to India or move out of US for stamping? 3.Incase I am required to go for stamping and my L1 gets rejected, can I still be on H4? Attorney_7 Posted April 22, 2011 Report Share Posted April 22, 2011 Generally, one is allowed to stay in the U.S. while a timely filed change of status case is pending. Once the status is approved, a visa is not necessary to begin the authorized employment for the status. However, if the beneficiary travels outside the U.S. he/she will need to obtain a visa in order to re-enter the U.S. Link to comment
