I received email from my employer that I am not eligible for H1 cap this year as I will be in my 6th year of L1A by October 2016. Not sure from when is this policy change effective, could you please let me know if I can file H1 from outside employer and if what are my options of transferring from current Green card petition? I have my I140 approved with the current employer Thank you Link to comment
jairichi Posted December 15, 2015 Report Share Posted December 15, 2015 The policy never changed. It is what your employer said. To be eligible for H1B after 6 years on L1A you need to stay outside US for one year after which s cap subject H1B petition has to be filed and approved. Link to comment
