Old H1B Question

Hi Friends, 

Could any please let me know on this at the earliest? 

One of my friend was on H1B visa (which is valid till end of 2017) and due to some issues he left that company then moved to H4 based on his wife's H1B. Recently her I1-40 got approved and he got an EAD based on H4 and started working with different company. 

Here my question is, can he go back onto H1B (which was valid till end of 2017)? If yes, then how?

Yes. Employer needs to file a cap exempt H1B petition & on approval he can join employer.

yes, new H1B can be applied under cap exempt.

Is this need to be done by the current employer or the one from whom he got approval till end of 2017 (old employer)?

he can join anyone he wants. doesnt have to be same employer
