Will I be cap-exempt if I leave US and re-apply after few years ?

Will the H1B cap apply if I previously had an H1B, stayed in US for close to 2 years working for my employer, returned to my home country, and then got a new job offer in the US with a different employer?

If you have been abroad for over a year, you have a choice:

- Be cap-exempt and get the remainder time, or

- File under the quota and get the full 6 years.
